Warner Bros. wins legal victory against the Tolkien Estate

It has been months since the Tolkien Estate originally sued Warner Bros. and the Paul Zaentz Company $80 million for overstepping the bounds of their contract. Since then, Warner Bros. has filed a counter-claim saying that the lawsuit damaged them financially and has undermined their contractual rights. This also was some months ago. Progress is always slow in the courts, yet every once in a while something exciting happens.  

The Tolkien Estate and an entity known as The Fourth Age Ltd. recently filed a motion to dismiss Warner Bros. suit. However, the motion was denied by Judge Audrey Collins. You can read the full six-page order here, but all you really need to know is what it says at the end:

"For the foregoing reasons, Fourth Age’s Motions to Dismiss Amended Counterclaims and Special Motions to Strike Amended Counterclaims (docket nos. 40, 41, 42, and 43) are DENIED.
IT IS SO ORDERED."

Warner Bros. lawyer Daniel Petrocelli says, "Someone in this legal drama is going to be grabbing the ring, if you know what I mean."
